Stay Sunday

1. Scope and contracting parties

1.1 These General Terms and Conditions (hereinafter “Terms” or “GTC”) apply to all contracts for the temporary rental of apartments and hotel rooms for accommodation concluded between Bay One Hospitality Group AG, Hauptstrasse 30, 8268 Mannenbach-Salenstein (hereinafter “Stay Sunday”) and third parties (hereinafter the “Guest”), as well as to all additional services and supplies provided by Stay Sunday (together, the “Accommodation Agreement”).
1.2 These GTC apply exclusively. Any general terms and conditions of the Guest that deviate from, conflict with, or supplement these GTC shall only become part of the contract if Stay Sunday has expressly agreed to their application.
1.3 Any GTC of the Guest are not recognised and shall apply only where expressly agreed in advance between the parties.

2. Conclusion of contract

2.1 The contracting parties are Stay Sunday and the Guest. By making a booking for one or more apartments or rooms, and any additional services, an Accommodation Agreement is formed. If the booked apartment is available, the Guest will receive a reservation confirmation from Stay Sunday. Upon Stay Sunday’s acceptance of the Guest’s reservation, an Accommodation Agreement comes into existence between Stay Sunday and the Guest.
2.2 If a third party has booked on behalf of the Guest, such third party shall be jointly and severally liable to Stay Sunday together with the Guest for all obligations under the Accommodation Agreement, provided that Stay Sunday has received a corresponding declaration from such third party.
2.3 The minimum age for a Guest making a booking is 18 years. Minors are not permitted to stay in an apartment without an adult legal guardian.
2.4 Offers by Stay Sunday concerning available apartments are without obligation and non-binding. Stay Sunday may, at its sole discretion, decline to enter into an Accommodation Agreement.
2.5 There is no entitlement to accommodation in a specific apartment. Stay Sunday reserves the right to define industry-standard restrictions for certain dates, such as minimum stays, booking guarantees, or deposits.

3. Cancellation and no-show

3.1 A reservation is deemed “guaranteed” once payment by the Guest has been received by Stay Sunday. A guaranteed reservation may be cancelled by the Guest in accordance with the cancellation policy stated by Stay Sunday and upon providing the reservation number, unless the Guest has chosen a non-refundable rate.
3.2 A cancellation means the apartment is no longer reserved for the Guest and the Guest is entitled to a refund of amounts already paid. The Guest’s entitlement to a refund lapses if the Guest fails to cancel by the deadline agreed with Stay Sunday and shown in the booking.
3.3 After expiry of the cancellation period, cancellation by the Guest is excluded. Stay Sunday retains the claim to the agreed remuneration—despite non-utilisation of the service—less any saved expenses.
3.4 Stay Sunday also retains the claim to the agreed remuneration in the event of the Guest’s no-show or early departure.
3.5 In the case of multi-day guaranteed reservations, in a no-show scenario Stay Sunday not only retains the claim to the agreed remuneration, but also reserves the right to release the apartment for all subsequent nights as from (and including) the second night.
3.6 A Guest who has already checked into the apartment on the arrival day loses the right to cancel free of charge upon check-in.
3.7 For bookings of five or more apartments (“Group Bookings”), cancellation is possible up to eight (8) weeks before arrival. If the Guest withdraws up to four (4) weeks before arrival, Stay Sunday is entitled to charge 50% of all reserved services. If the Guest withdraws at a later point in time, Stay Sunday is entitled to charge 100% of all reserved services.
3.8 For bookings made via third-party providers, cancellations may only be made in accordance with the terms agreed between the Guest and such provider.

4. Accommodation rates and other prices

4.1 The prices displayed by Stay Sunday at the time the contract is concluded shall apply. The applicable prices are gross total prices and include all statutory taxes, fees, and charges.
4.2 Local charges which, under applicable law, are owed by the Guest (e.g., city/bed taxes) are not included and will be charged separately.
4.3 In the event of changes to tax, fee, or charge rates, or the effective introduction of new taxes, fees, or charges, Stay Sunday reserves the right to adjust prices accordingly. In contracts with consumers, this applies only if the period between contract conclusion and price adjustment exceeds four months.
4.4 Stay Sunday may make its consent to any subsequent reduction requested by the Guest in the number of booked apartments or in the length of stay conditional upon an increase in the daily rate due to the shorter rental period or reduced rental volume.

5. Payment terms

5.1 The price for the entire booked accommodation service must always be paid by the Guest in advance.
5.2 The Guest is not entitled to set off claims, unless the set-off concerns an undisputed or finally adjudicated claim.
5.3 Accepted means of payment are Mastercard and Visa. Cash payments are excluded.
5.4 The reference date for payments in foreign currencies is the date on which payment is received by Stay Sunday. In the event of a refund, this same reference date applies.
5.5 For fees incurred subsequently due to additional services used or breaches of these GTC, Stay Sunday reserves the right to charge the outstanding amounts to the stored payment method.
5.6 Invoices issued by Stay Sunday without a due date are payable immediately upon receipt without deduction.
5.7 Stay Sunday is entitled to declare accrued claims due at any time and to demand immediate payment. In the event of default, Stay Sunday is entitled to charge the applicable statutory default interest.

6. Use of reserved apartments

6.1 A reserved apartment is available to the Guest from 15:00 on the arrival day and until 11:00 on the departure day. The Guest has no entitlement to earlier provision on the arrival day or extended provision on the departure day.
6.2 Unless otherwise agreed, any keys and, where applicable, key cards provided on the agreed departure day must be returned to Stay Sunday or a designated third party or, if agreed, left in the apartment.
6.3 A later departure (“Late Check-out”) may be agreed with Stay Sunday in advance upon request and subject to availability. If Stay Sunday consents to a late check-out, Stay Sunday is entitled to charge a fee for the additional use of the apartment. For departures after 14:00, the full current daily rate is charged.
6.4 If the Guest fails to vacate the apartment by 11:00 at the latest, Stay Sunday may charge 50% of the full current daily rate for late vacating up to 14:00 and 100% thereafter.
6.5 An earlier arrival (“Early Check-in”) may be agreed with Stay Sunday in advance upon request and subject to availability. If Stay Sunday consents to an early check-in, Stay Sunday is entitled to charge a fee for the additional use of the apartment.

7. Resale and improper use

7.1 The resale/subletting and/or onward brokerage of booked apartments is expressly prohibited. In particular, onward brokerage of apartments and/or apartment allotments to third parties at prices higher than the actual apartment prices is not permitted.
7.2 The assignment or sale of claims against Stay Sunday is also not permitted. In such cases, Stay Sunday is entitled to cancel the booking.
7.3 Use of the apartment for any purpose other than accommodation—particularly commercial use by the Guest—is expressly prohibited. In the event of a breach, Stay Sunday reserves the right to terminate the contract with immediate effect.
7.4 Subletting of the apartments provided and use for purposes other than accommodation require the prior express consent of Stay Sunday in text form.

8. Liability of Stay Sunday

8.1 Stay Sunday shall be liable without limitation for damages for which it is responsible arising from injury to life, body, or health. Stay Sunday shall further be liable for other damages caused by intentional or grossly negligent breach of duty.
8.2 In cases of simple negligence, Stay Sunday shall be liable only for the contract-typical, foreseeable damage and only insofar as a duty has been breached the fulfilment of which enables the proper performance of the Accommodation Agreement in the first place (a “cardinal duty”).
8.3 Should disruptions or defects occur in the services of Stay Sunday, Stay Sunday will, upon becoming aware of them or upon the Guest’s prompt notification, endeavour to remedy them.
8.4 Liability for items brought into the apartment is governed by the statutory provisions. Any claim lapses if the Guest fails to notify Stay Sunday without undue delay after obtaining knowledge of loss, destruction, or damage.
8.5 If the Guest brings money, securities, and valuables with a value exceeding CHF 1,000 into the apartment, Stay Sunday’s liability is limited to the aforementioned amount. For other items with a value exceeding CHF 4,000, liability is limited to one hundred times the price of the booked apartment for one day, but not exceeding CHF 4,000.
8.6 If a parking space is provided to the Guest, no contract of safekeeping is created thereby. There is no duty of supervision. In the event of loss or damage, Stay Sunday is liable only in cases of intent or gross negligence on its part.
8.7 All claims against Stay Sunday shall become time-barred within one year from the statutory commencement of the limitation period. This does not apply to claims for damages arising from injury to life, body, or health; the statutory limitation period applies to such claims.
8.8 Stay Sunday assumes no liability for lost property. Lost property will be returned only upon request, against reimbursement of costs and a handling fee of CHF 15.00.

9. Security deposit

9.1 To secure all claims of Stay Sunday against the Guest under the Accommodation Agreement, Stay Sunday may require a security deposit from the Guest prior to handover of the apartment.
9.2 Stay Sunday may obtain a pre-authorisation on the Guest’s payment card as the security deposit.
9.3 Stay Sunday shall settle the security deposit within one month after termination of the Accommodation Agreement.

10. Customer data and digital check-in

10.1 To ensure communication with the Guest, Stay Sunday mandatorily collects the Guest’s email address and telephone number.
10.2 To verify the Guest’s identity and comply with local legal obligations, Stay Sunday is entitled to request certain information from a valid identification document at check-in via the LikeMagic app.
10.3 If a Guest’s identity cannot be verified beyond doubt at digital check-in due to missing or incorrect documents or wilful manipulation, Stay Sunday is entitled to cancel the booking and deny the Guest access to the property.
10.4 Unregistered visitors or guests are not permitted on the premises. Only the guests listed in the booking may enter the apartment.

11. Termination of the Accommodation Agreement

11.1 Stay Sunday is entitled to terminate the Accommodation Agreement for cause.
11.2 Good cause exists in particular if:
a) force majeure or other circumstances not attributable to Stay Sunday make performance impossible,
b) apartments are culpably booked under misleading or false information,
c) Stay Sunday has justified reason to assume that use of the service may jeopardise smooth business operations, safety, or reputation,
d) the purpose or reason for the stay is unlawful,
e) there is any resale/subletting and/or onward brokerage,
f) these GTC are breached.
11.3 Stay Sunday shall inform the Guest without undue delay of the exercise of the right of termination.
11.4 In the event of justified termination by Stay Sunday, the Guest shall have no claim for damages.

12. Vouchers

12.1 A voucher purchased from Stay Sunday may be redeemed only for services provided by Stay Sunday. Any remaining balance after payment by voucher remains and may be used for further bookings.
12.2 Vouchers cannot be returned, are not resalable or transferable, and cannot be redeemed for cash.
12.3 Right of withdrawal: Declarations relating to vouchers may be withdrawn within 14 days without stating reasons. The withdrawal must be sent to: info@staysunday.com.

13. No-smoking policy

13.1 Stay Sunday apartments are non-smoking. Smoking is therefore prohibited in the common areas, guest apartments, and on balconies and/or terraces.
13.2 The no-smoking policy applies to all product categories and therefore includes, in addition to cigarettes, e-cigarettes, vapes, hookahs, herbal cigarettes, and similar devices.
13.3 A breach of the general no-smoking policy constitutes improper use and is sanctioned by Stay Sunday with a contractual penalty of CHF 250.00.
13.4 The intentional or negligent triggering of the fire alarm system or smoke detectors (for example, as a result of a breach of the no-smoking policy) will be charged to the Guest in full in at least the amount of the actual costs incurred.
13.5 Manipulating or blocking emergency exits, fire extinguishers, or the fire alarm system is prohibited. In the event of a breach, a penalty fee of CHF 200.00 applies.
13.6 The Guest remains entitled to prove that a lesser loss has occurred.

14. Quiet hours and no parties

14.1 Noise is to be avoided in the booked apartment, the common areas, and on the surrounding grounds. Quiet hours from 22:00 to 06:00 must be strictly observed.
14.2 Loud events with multiple persons (“parties”) are not permitted in the apartments.
14.3 A breach of quiet hours or the no-party rule constitutes improper use and is sanctioned by Stay Sunday with a contractual penalty of CHF 400.00.
14.4 The Guest remains entitled to prove that a lesser loss has occurred.

15. Damage or theft

15.1 The Guest shall treat the apartment with care and, in particular, avoid heavy soiling. In the event of heavy soiling, Stay Sunday is entitled to charge the Guest an additional cleaning fee of at least CHF 100.00.
15.2 If damage beyond normal wear and tear occurs, or in the event of theft, Stay Sunday is entitled to charge the Guest both for the damage and for the separate expenses incurred to remedy the damage.
15.3 Intentional damage to inventory, furniture, or the apartment itself—besides the claim for damages—constitutes improper use and will therefore be sanctioned with a contractual penalty of CHF 200.00 per incident.
15.4 The Guest remains entitled to prove that a lesser loss has occurred.

16. Pets

16.1 Bringing a pet is generally not permitted unless Stay Sunday has granted approval. The exception is for guide dogs for the blind, hearing dogs, and comparable service dogs, which may be brought free of charge upon proof.
16.2 If the Guest brings a pet into an apartment without approval, a flat special-cleaning fee of CHF 200.00 will be charged.

17. Maintenance

17.1 The Guest undertakes to treat the apartment provided, the furnishings, and the rooms, facilities, and installations intended for communal use with care.
17.2 Upon taking possession of the apartment, the Guest undertakes to check the furnishings for completeness and serviceability and to notify any complaints without delay via the LikeMagic app.
17.3 The Guest is liable for all damage to the apartment provided that the Guest or their visitors have culpably caused by improper use.
17.4 The apartment is regularly cleaned by Stay Sunday. The Guest is obliged to grant access to the apartment to the service provider commissioned by Stay Sunday for this purpose. If the mandatory cleaning is refused by the Guest, the Guest shall pay a fee of CHF 200.00.

18. Group bookings / allotment contracts / event periods

18.1 Separate payment and cancellation conditions apply to group bookings of more than five apartments and to allotment contracts.
18.2 Different cancellation periods may apply for bookings during event and trade-fair periods. These will be indicated during the booking process and on the booking confirmation.

19. Internet use

19.1 Stay Sunday provides the Guest with internet access within the existing technical and operational capabilities. Disruptions cannot be excluded.
19.2 The Guest may not use the internet connection unlawfully. Unlawful use particularly includes: downloading and distributing copyrighted content, illegal streaming services, and posting, retrieving, or transmitting content relevant under criminal law.
19.3 The Guest is prohibited from sharing access credentials for the internet connection with third parties.

20. Data protection

The privacy policy of Stay Sunday is available at https://www.staysunday.com/datenschutz.

21. Final provisions

21.1 Amendments and supplements as well as termination of the Accommodation Agreement or these GTC must be in writing. Unilateral amendments or supplements by the Guest are invalid.
21.2 The place of performance and payment is the registered seat of the accommodation business.
21.3 The exclusive place of jurisdiction is Zurich, Switzerland.
21.4 Swiss law applies. Application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
21.5 Should individual provisions of these GTC be or become invalid or void, the validity of the remaining provisions shall not be affected.
21.6 Stay Sunday is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
